Medical Council of India vs Vigyan Bharati Charitable Trust (Regd) and Anr

Bench: 3 — <UNKNOWN>

In Brief

A medical institution (Vigyan Bharati Charitable Trust) sought to admit MBBS students for 2015-16 without obtaining required approvals from the Medical Council of India. The Orissa High Court issued an interim order directing provisional permission and allowing admissions. The Supreme Court reversed this, holding that when a statutory regulator has not granted required permissions, interim orders directing admissions are unjustified. The Court held that admissions made pursuant to such orders are subject to the writ petition outcome and confer no equitable rights. Since the academic year had concluded, the Court found no reason to examine the matter further and dismissed the underlying writ petition.
