Meerut Kendriya Thok Upbhokta Sahakari Bandar vs Vakil Chand Jain and Ors etc. etc

Bench: 2 — Kurian

In Brief

The Supreme Court set aside the High Court's dismissal of applications for condonation of delay in filing review petitions. The appellants had sought a review of the High Court's judgment after obtaining liberty from the Supreme Court in an earlier special leave petition. The High Court had dismissed the condonation applications for want of prosecution. The Supreme Court held that the delay was substantially caused by pendency of the earlier SLP proceedings before it. To avoid further litigation, the Court condoned the delay, restored the applications, and remitted the review petitions to the High Court for disposal on merits with a request for expeditious completion within one month.
