Supreme Court of India 2017-02-03 disposed

Meerut Kendriya Thok Upbhokta Sahakari Bandar vs Vakil Chand Jain and Ors etc. etc

Bench: 2 — Kurian

In Brief

The Supreme Court addressed whether the High Court correctly dismissed applications for condonation of delay in filing review petitions. The appellants had previously obtained liberty to file review petitions from the Supreme Court, but the High Court dismissed the condonation applications for want of prosecution. The Court held that since the delay was largely attributable to pursuing the prior special leave petition, condonation was justified. Setting aside the High Court's dismissal order, the Court restored the applications and remitted them for consideration on merits, requesting expeditious disposal within one month to avoid prolonged litigation in this long-pending matter.
