Mirza Iqbal @ Golu & Anr vs State of Uttar Pradesh & Anr

Bench: 2 — R. Subhash Reddy

In Brief

The appellants, brother-in-law and mother-in-law of a deceased woman, were accused of dowry-related offences including her death by hanging. The first appellant claimed to have been working at an ICICI Bank 40 kms away at the time of the alleged incident. The FIR and chargesheet contained only vague allegations against the appellants without specific overt acts showing their involvement. The Supreme Court quashed the proceedings, holding that merely naming family members in matrimonial dowry cases without concrete allegations of active participation constitutes abuse of judicial process and prevents oppression through false implication.
