MOHAMMAD IRFAN vs STATE OF KARNATAKA

Bench: 3 — Uday Umesh Lalit, Hemant Gupta, S. Ravindra Bhat

In Brief

Five accused (A-1 to A-6, with A-7 acquitted) were convicted of criminal conspiracy to destabilize India through terrorist activities under Lashkar-e-Toiba (LeT). Evidence showed meetings where they discussed acquiring explosives and weapons to target important installations and places of worship. Minutes of meetings, handwriting evidence, recovery of explosives, arms, and inflammatory literature proved their intent. The High Court modified convictions, acquitting them under Sections 120-B and 121 IPC but upholding conviction under Section 121-A for conspiracy. The Court rejected arguments that insufficient time elapsed between meetings and recoveries, that one accused was ignorant of Kannada, or that life imprisonment was excessive, confirming the conviction and enhanced sentence.",
