The appellants' land in village Khora was acquired under the Land Acquisition Act, 1894, with compensation initially set at Rs.70 per sq. yard and later enhanced to Rs.106. They filed appeals 12 years late, seeking parity with co-owners who obtained Rs.130–150 per sq. yard. The Supreme Court condoned the delay to prevent hostile discrimination under Article 14, but denied them interest benefits earned during the delay. The court rejected claims to match compensation rates for village Makanpur, as this would reward delayed action. Compensation was set at Rs.150 per sq. yard with deficiency in court fees to be recovered.
