Mohinder Singh vs Jaswant Kaur (D) Thr. Lrs

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Mohinder Singh appealed against a Punjab and Haryana High Court judgment that dismissed his appeal on the ground that a carbon copy of a document, even though signed by both parties, could not be treated as an original document under Section 62 of the Indian Evidence Act. The Supreme Court held this reasoning was incorrect. When a carbon copy is prepared through the same process as the original and is signed by both parties, it acquires the character of an original document. The Court set aside the High Court's dismissal and remitted the case for reconsideration on the merits.
