The Supreme Court upheld the High Court's dismissal of a suit for specific performance of a property sale agreement. The plaintiff had agreed to purchase two properties from the defendant in 1984. The High Court found the agreement materially altered, with portions written in different ink and inconsistent descriptions of the properties and their consideration. The Court held that material alterations can be determined without expert examination under Section 73 of the Indian Evidence Act when clearly discernible. Additionally, the Court found the plaintiff failed to establish proper readiness and willingness to perform, with the account statement falling short of the required consideration amount. The appeal was dismissed.
