Children of deceased government employees in Bihar who applied for compassionate appointment sought regular pay scale appointments, but some were appointed on fixed pay as Prakhand Teachers and Panchayat Shikshaks. The Supreme Court distinguished between two groups: those recommended for Class III/IV posts before 01.07.2006 are entitled to regular pay scale appointment or continuation, as they fall within a prior legal regime protecting such entitlements. Those recommended after 01.07.2006, when new Rules came into effect, are not entitled to regular pay scales and may be appointed only on fixed pay under those Rules. Appeals were allowed for the first group.
