Children of deceased government employees who were recommended for compassionate appointment to Class III posts prior to July 1, 2006, but appointed on fixed pay as Prakhand Teachers and other lower positions, are entitled to either regular appointment in Class III/IV posts or payment of regular pay scales in their current posts. Those recommended or appointed after July 1, 2006, when new employment rules came into force, are not entitled to such relief as the new rules established a separate fixed-pay compassionate employment scheme. The Court distinguished between beneficiaries based on the implementation date of the 2006 Rules.
