Samir Bharatbhai & Ors vs State of Gujarat & Ors

Bench: 2 — Pamidighantam Sri Narasimha, Joymalya Bagchi

In Brief

Contractually appointed Assistant Professors in Gujarat Government engineering colleges sought parity in pay with regularly and ad hoc appointed Assistant Professors, arguing they performed identical teaching and administrative duties. The Court held that the constitutional principle of "equal pay for equal work" applies. Contractual appointment does not bar relief. The Court directed payment of minimum pay scale for Assistant Professors with 8% arrears from three years before filing the writ petition, dismissing the State's appeals and allowing the Assistant Professors' appeals in part.
