In Brief
Two writ petitions filed by NCCF employees' union sought to declare NCCF a "State" under Article 12 of the Constitution and claim arrears and entitlements relating to the 6th and 7th Pay Commissions. The petitions noted conflicting High Court judgments on NCCF's constitutional status: the Delhi High Court had ruled it was not a "State," while the Patna High Court held it was. The Supreme Court allowed withdrawal of both petitions with liberty to file fresh proceedings under Article 226, after NCCF itself withdrew its own appeals against the Patna judgment, leaving all substantive issues open for decision in appropriately instituted proceedings.
