The appellant was convicted of murdering his former lover by dashing her head against a wall during a quarrel in her home. The victim died from head injuries ten days later. The Supreme Court partly allowed the appeal, converting the murder conviction under Section 302 IPC to culpable homicide not amounting to murder under Section 304 Part II. The Court held that the unpremeditated, single assault occurring during a brief lovers' quarrel (2-3 minutes) demonstrated knowledge that death might result, not intention to kill. The appellant was sentenced to time already served and released.
