Vijender alias Bijjo vs State (Govt. of NCT of Delhi)

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Vijender and his co-accused Om Prakash were convicted of murdering Vijender's sister Anita with multiple injuries from knife and wooden plank. The Supreme Court found Om Prakash caused fatal injuries by knife (sufficient to cause death individually), while Vijender caused non-fatal injuries with a blunt wooden plank. Examining intention to kill, the Court noted Vijender was unarmed, used a blunt weapon, and acted on hot-blooded quarrel without express intent to kill. The Court converted his conviction from murder under Section 302 IPC to culpable homicide not amounting to murder under Section 304 Part II IPC (knowledge but no intention to cause death), reducing sentence to 10 years already served.
