National Company Law Tribunal and Appellate Tribunal Bar Association through its Secretary vs Ministry of Corporate Affairs & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

A Bar Association representing members of the National Company Law Tribunal (NCLT) and National Company Law Appellate Tribunal (NCLAT) petitioned for directions to fill officer vacancies and extend six members' tenure ending in June 2021. The Court found that member strength had depleted to 39 out of 63 sanctioned positions, adversely affecting tribunal functioning. The Supreme Court directed the Government to complete the reappointment process expeditiously within two months, noting no fresh advertisement was needed, and ordered a selection committee be constituted to fill remaining vacancies.
