Navnirman Development Consultants (I) Pvt. Ltd vs Divisional Commissioner

Bench: 2 — Abhay Manohar Sapre

In Brief

A construction company challenged a High Court order dismissing its arbitration appeal, which arose from a dispute over non-payment of bills. The arbitrator awarded Rs. 25.64 lacs; the District Judge reduced it to Rs. 7.15 lacs. The High Court dismissed the appeal without recording reasoned findings or addressing the parties' contentions. The Supreme Court held that appellate orders must contain factual details, parties' stands, applicable law, and reasoned findings on all issues. Dismissal in the absence of both parties is improper under Order 41, Rule 17 CPC. The judgment was set aside and remanded for fresh adjudication on merits by the High Court."
