In Brief
This case concerns whether B.Ed.-qualified teacher candidates with 50% marks in post-graduation could be excluded from recruitment solely because their graduation marks fell below 50%—a requirement newly imposed in a 2011 NCTE notification, when this was previously optional. The Supreme Court held that candidates who obtained qualifications when the graduation percentage requirement did not exist cannot be retrospectively subjected to it, as this violates Article 14. Following similar relief granted by Rajasthan and Uttarakhand High Courts and the NCTE's acceptance of those judgments, the Court directed equivalent relief for the appellants and directed NCTE to issue a clarificatory supplementary notification.
