New India Assurance Co. Ltd vs Gajender Yadav and Ors

Bench: 2 — Kurian

In Brief

A security officer aged 37 suffered amputation of his left leg below the knee in a motor accident. The High Court awarded ₹27.14 lakhs compensation but had separately awarded amounts for physical disability and future loss of earnings, causing duplication. The Supreme Court held that such compensation should not be duplicated and recalculated it using a 40% disability factor applied to the revised salary (₹21,000 including future prospects) multiplied by a multiplier of 15 for the employee's age, yielding ₹15.12 lakhs for future earnings loss. The Court also awarded an additional ₹2 lakhs for periodic prosthetic limb replacement and interest at 8% per annum, reducing the total to ₹23.26 lakhs.
