New India Assurance Co. Ltd vs Santoshi Devi : Master Priyanshu : Baby Priya : Baby Preeti : Kumar Lal : Rohitash Gurjar : Hansraj Gurjar

Bench: 1 — S. Mehta

In Brief

In this motor vehicle accident case, the driver reversed a truck negligently, causing the death of a worker. The trial court awarded Rs. 21,53,000/- compensation. The insurance company appealed, arguing the driver's license was expired at the time of the accident and seeking recovery rights against the owner and driver. The Court held that a license renewed within 30 days of expiry by paying penalty is deemed valid on the accident date. Therefore, the insurance company must pay full compensation without recovery rights, as the driver held a valid license. Both appeals were partly allowed, modifying only the recovery provisions."
