Ningappa vs State of Karnataka

Bench: 2 — N.V. Ramana

In Brief

Ningappa, a school warden, was convicted under Sections 354 and 109 of the IPC for sexually harassing a female daily-wage worker and sentenced to two years imprisonment. The High Court upheld the conviction. On appeal, the Supreme Court allowed an application to compound the offence after the complainant filed an affidavit stating that the parties had settled amicably, relations had become cordial, and she no longer wished the appellant to undergo sentence. The Court set aside the conviction and sentence, holding that such offences were compoundable under Section 320 of the Code of Criminal Procedure and that justice was served by permitting the settlement.
