The Court set aside a High Court judgment that had directed the State of Bihar to appoint two respondents (dependents of deceased teachers who died in 2006) to regular government posts on a compassionate basis. The Supreme Court held that since the appointments were made after 1 July 2006 (when new Rules governing such appointments came into force), the respondents were entitled only to fixed-pay posts as Nagar Shikshaks under the Rules, not regular government posts. The Court rejected the High Court's reliance on an earlier instruction and permitted the respondents to seek relief from the State Government outside the statutory framework.
