Parivartan & Ors vs Union of India & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Parivartan filed a writ petition seeking direction to the government to establish an independent authority for whistle-blower protection. Following judicial monitoring over several years, Parliament enacted the Whistle Blowers Protection Act, 2011, which received Presidential assent in May 2014. The government, however, did not immediately implement it, citing deficiencies and conflicts with the Right to Information Act. The Court held that once an enactment emerges from Parliament, petitioners may challenge amendments if they wish; but premature challenges to proposed amendments before final enactment are not justiciable. The petition was disposed of, leaving open the right of petitioners to challenge the eventual amended legislation after parliamentary approval."
