In Brief
The Supreme Court interpreted Regulation 9 of the Punjab State Electricity Board Service of Engineers (Civil) Recruitment Regulations, 1965 regarding promotion from Junior Engineer to Assistant Engineer positions. The central issue was whether an employee's service ranking for promotion should include only experience after obtaining an AMIE/BE qualification or could include earlier service. The Court held that the Clarification to Regulation 9 unambiguously provides that eligibility for promotion is determined from the date of qualifying the examination. Accordingly, only post-AMIE service counts for ranking. The Court set aside a Division Bench judgment that had permitted inclusion of pre-qualification service, affirmed the appellant's promotion, and declined to recover benefits from respondents due to changed circumstances."
