Parveen Gera vs Haryana State Electricity Board & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court clarified the interpretation of Regulation 9 governing promotion of Junior Engineers to Assistant Engineer posts in the Haryana State Electricity Board. The dispute involved whether engineers who obtained AMIE/BE qualifications could count their pre-qualification service towards seniority for promotion ranking. The Court upheld a Clarification to Regulation 9 stating that eligibility and ranking must be determined from the date of obtaining AMIE/BE qualification, not from initial employment as Junior Engineers. The Division Bench had wrongly set aside this Clarification without direct challenge. The Court allowed the appeal, restoring the appellant's promotion as number one in the ranking list, while directing no recovery be made from respondents already employed or promoted in service.
