In this criminal appeal, three out of seven convicted persons challenged their convictions for murder committed by an unlawful assembly in Madhya Pradesh. The incident involved a motorcycle attack on the deceased while returning home at night. The Supreme Court found that the three appellants were not named in the initial FIR ('Dehati Nalishi') and there was no credible eyewitness evidence placing them at the crime scene or identifying them as participants. Despite eight of the fifteen accused being acquitted at trial, the Court held that the absence of proper identification and evidentiary support against these three appellants warranted their acquittal. The appeals were allowed and the appellants were ordered to be set free."
