The Supreme Court dismissed a petition challenging the shifting of certain candidates from reserved category posts to open category in a police constable recruitment list. The petitioners argued that 958 candidates initially selected for reserved posts were wrongly moved to open posts, prejudicing open category candidates. The Court held that when additional vacancies arose within the same 2013 selection process, candidates previously selected for reserved posts who possessed sufficient merit to qualify for open posts could validly be considered for open posts. This reworking, undertaken strictly according to merit and reservation principles, was lawful and not illegal. The petitioners had not shown that any lower-scored candidate was selected ahead of them.
