An illiterate elderly woman in her eighties had granted a Power of Attorney to another person to represent her in a civil suit for permanent injunction over a plot of land. When she sought to examine the Power of Attorney Holder instead of testifying herself, the Trial Court and High Court rejected this request. Upon her counsel's statement that she would testify personally, the Supreme Court set aside the High Court's judgment. The Court held that the plaintiff has the right to appear and give evidence herself, with the option to be examined on commission at her residence if her age made court attendance difficult.
