The appellant, an elderly illiterate woman, sought permission in a long-pending land dispute suit to have her Power of Attorney holder examine on her behalf instead of testifying personally. The High Court dismissed her writ petition challenging the Trial Court's refusal. In this appeal, when the appellant's counsel undertook to have her testify personally, the Supreme Court found it unnecessary to examine the High Court's judgment on its merits. The Court allowed the appellant to appear personally or, given her age, to be examined on commission at her residence, and directed the trial court to conclude the 34-year-old case within six months.
