Public Trust Shri Geeta Satsang Bhawan vs Nand Lal & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

A public trust filed eviction suits against tenants in 1999 while the trust was unregistered. The trial court decreed the suits in 2004, but the appellate court dismissed them on the ground that the trust was not registered under the Rajasthan Public Trust Act, 1959. The Supreme Court held that Section 29 bars only the 'hearing and deciding' of such suits, not their filing. Once the trust obtained registration during the appeal's pendency, the bar was lifted. The Court set aside all prior orders and remanded the case to the trial court for a fresh hearing on merits, as any decree passed by an unregistered trust was without jurisdiction.
