Punjab National Bank vs PNB Canteen Workers Union (Calcutta) & Ors

Bench: 2 — Kurian

In Brief

Punjab National Bank sought to challenge an order for absorbing 29 canteen workers. The workers, represented through their union, claimed entitlement to absorption similar to 23 workers already appointed. The Supreme Court invoked its extraordinary powers under Article 142 to settle the dispute in the interest of justice. The Court allowed the appeal, set aside the High Court's judgment, and directed the Bank to immediately appoint all 29 workers on identical terms: half the wages of Class-IV employees or minimum state wages (whichever is higher), with all benefits granted to the 23 already-appointed workers, with effect from the date the 23 were appointed.
