A petitioner who worked for the High Court of Manipur sought promotion to Assistant Registrar. Her promotion was denied in 2021, but she challenged the decision, arguing that her evaluation unfairly included an ACR (Annual Character Report) from 2016-17 that was never communicated to her, and another ACR from 2019-20 that was communicated only one day before the promotion committee meeting. The Supreme Court held that uncommunicated ACRs cannot be used in promotion decisions, and when an ACR is communicated too late to allow proper response time, it should be treated as uncommunicated. The Court set aside the denial and ordered the committee to reconsider her case using only the properly communicated ACRs, in which she had received higher grades.
