Two candidates selected in 2003 for the post of Civil Judge (Junior Division) in Chhattisgarh challenged their placement in a supplementary waiting list despite scoring higher marks than women candidates selected under reservation. In 2012, a High Court bench directed their appointment. However, the State delayed implementation and finally appointed them in July 2013, after candidates from the 2012 batch had already been appointed in July 2012. The Supreme Court held that the appellants' right to seniority accrued from the 2012 High Court order, not their actual appointment date. Partly allowing the appeal, the Court directed the appellants be shown senior to the 2012-batch officers, finding the State's delay should not prejudice the judicial order.
