Three Assistant Teachers appointed in 1999 had their salaries stopped from October 2005 after the school allegedly manipulated a sanction order showing three vacancies instead of two. The Supreme Court held that the appellants, as bona fide applicants from the open market with no blameworthy conduct, could not be penalized for manipulation by school management. The Court set aside the High Court's judgment, ordered full payment of arrears from 1999-2002 and 50% backwages from October 2005 onwards, restored their deemed-in-service status, and granted consequential service benefits.
