Two passengers died when their horse cart collided with a vehicle. The lower court deducted 50% compensation claiming the deceased were contributorily negligent because the cart was in the middle of the road. The Supreme Court reversed this, holding that passengers cannot be held liable for contributory negligence simply because of the vehicle's position. Since the deceased did not drive, own, or supervise the cart, no fault could be attributed to them. The Court set aside the unjustified deduction and allowed full compensation as claimed.
