The Gujarat Water Supply and Sewerage Board's daily-rated employees sought benefits under Government Resolutions of 1991-92, claiming they deserved the same pay scale (Rs.950-1500) granted to similarly situated employees. The High Court's single judge allowed their claim under Article 14 (equality), but the division bench reversed this. The Supreme Court upheld the reversal, holding that the Board—an autonomous statutory body—was not obligated to adopt the 1991-92 resolutions merely because it had adopted an earlier 1988 resolution. Benefits mistakenly given to some employees had been withdrawn, so negative equality could not compel their perpetuation.
