The Supreme Court dismissed an appeal challenging a High Court order that declared an accused a juvenile on the date of an alleged murder. The Court held that the Juvenile Justice Board had no power to review its earlier acceptance of the accused's date of birth (08.09.2003) recorded in a school certificate. Once such documentary evidence is available, an ossification test cannot be ordered. The Court affirmed the accused was 17 years old on the incident date and therefore a juvenile delinquent. On the bail issue, having been granted bail three years earlier with no evidence of misuse, the Court declined to interfere with the bail order.
