Nine employees appointed as part-time sweepers under a special recruitment drive (2006-2007) challenged their exclusion from regular pay-scale benefits. The Division Bench of the Madhya Pradesh High Court had distinguished their case from Ram Naresh Prajapati, denying them the benefit. The Supreme Court held that all nine appellants, being appointed on sanctioned posts by a validly constituted selection committee on temporary basis at collector's prescribed rates, were entitled to regular pay-scale upon completing three years of service under the 1984 circular. The Court rejected the State's distinction based on absence of subsequent screening, finding them similarly situated to Ram Naresh Prajapati. The Court set aside the Division Bench order and upheld the Single Judge's judgment granting them regular pay-scale with arrears.
