Rakesh Kumar challenged the High Court's rejection of his petition under Article 226, seeking to quash corruption proceedings against him under the Prevention of Corruption Act, 1988. The Supreme Court, noting that the investigation was complete and sanction for prosecution had been issued, held that arrest was not necessary. Instead, the Court directed the appellant to present himself before the Trial Court within seven days with notice to the Public Prosecutor, whereupon the Trial Court was to grant bail subject to appropriate conditions ensuring his presence and participation in trial proceedings. The appeal was allowed.
