The Supreme Court dismissed a criminal appeal challenging a conviction under the Prevention of Corruption Act, 1988. The appellant contested the conviction on grounds of alleged defects in the investigation and sanction. The Court held that procedural irregularities in investigation or technical errors in sanction do not vitiate a conviction once cognizance has been taken and the trial has proceeded to conclusion, unless they cause a miscarriage of justice. Section 19(1) is procedural and does not affect jurisdictional competence. The conviction was upheld and the appellant ordered to surrender within four weeks to serve the remaining sentence.
