Ram Ishwar Rai vs State of Bihar

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A man was convicted under Section 376(2)(g) IPC for rape of a 13-year-old girl and sentenced to 10 years' imprisonment. He appealed, contesting the prosecutrix's credibility due to inconsistencies in her statement and lack of medical corroboration. The Supreme Court held that a rape victim's testimony, if beyond reproach, requires no corroboration; minor inconsistencies do not destroy credibility; and family enmity does not justify dismissing rape allegations. However, as the appellant had already served eight years, the Court reduced the sentence to time served and ordered his release.
