The Supreme Court partly allowed land acquisition compensation appeals relating to 16 properties in Dharuhera, Haryana acquired for Institutional Sector 5A development. While the Reference Court and High Court had awarded Rs. 55,71,010/- per acre, the Court found that the potentiality of the land and proximity to adjoining acquisitions (in Malpura and Kapriwas under the same urban development scheme) justified reliance on a higher comparable award. Taking Rs. 1,49,14,975/- per acre as the base value with appropriate temporal de-escalation and adjusting for change of land use costs, the Court enhanced compensation to Rs. 1,18,37,668/- per acre plus statutory benefits, reaffirming that land potentiality and multiple comparable sales must inform market value assessment.
