Ram Prakash and another (tenants) appealed against a High Court order evicting them on the ground that their rented building was dilapidated and required demolition under the U.P. Urban Building Act. The landlord argued the building was dangerous and required reconstruction. The tenants contended the building could be made safe through repairs. The Supreme Court allowed the appeal in part: it gave the tenants six months to repair the building at their own cost, without deducting repair expenses from rent. The Court directed a Town Planning Authority inspection after repairs to verify if the building is safe. Only if it remains unfit for habitation should the landlord be permitted to pursue further eviction proceedings."
