A landlord sought eviction of tenants from a dilapidated building under the U.P. Urban Building Act, Section 21(1)(b). The High Court had ordered eviction. The Supreme Court held that the tenants should be given an opportunity to repair the building at their own cost, with repair expenses not deductible from rent. The Court directed the tenants to complete repairs within six months, after which the municipal authority must inspect and determine whether reconstruction is still necessary. Only if repairs prove insufficient may the landlord pursue further eviction proceedings.
