In Brief

The Supreme Court resolved a landlord-tenant dispute over eviction of a building under the U.P. Urban Building Act. The landlord sought to evict tenants on grounds of dilapidation (Section 21(1)(b)). The Court held that since the tenants were willing to repair the building at their own cost, they should be given six months to do so. Repair expenses cannot be deducted from rent. The building must then be re-inspected by the Municipal Authority. If it remains dilapidated after repair, only then may the landlord proceed with eviction proceedings for reconstruction. The appeal was partly allowed on these terms.
