Rambhau S/o Tulshiram Ghuge vs State of Maharashtra and Ors

Bench: 3 — Kurian

In Brief

Elderly appellants sought to restore freedom fighters' pensions that had been cancelled by Maharashtra's State Government, allegedly because forged documents were used in obtaining them. The High Court had upheld the cancellation. The Supreme Court allowed the appeals, restoring the pensions. The Court held that at the appellants' advanced age, withdrawal of the modest benefit would render them unable to sustain themselves. The benefits were restored but made non-heritable, terminating upon each appellant's death. The Court clarified this was decided on peculiar facts and would not serve as precedent for other cases.
