In this case, the Supreme Court examined whether a suit for redemption of mortgage could succeed for properties subject to sale agreements. The plaintiffs sought to redeem mortgaged properties, but two of the properties were covered by sale agreements between the mortgagor and mortgagee. The Court held that under Section 53A of the Transfer of Property Act, 1882, such sale agreements cannot be defeated by a redemption suit. The failure of the mortgagee to pursue a specific performance suit does not negate the statutory protections afforded by Section 53A. Affirming the High Court's decision, the Court dismissed the appeal, finding no grounds to interfere with the lower courts' concurrent findings on the defendants' readiness and willingness to comply with the sale agreements."
