In Brief
The Supreme Court heard a criminal appeal against the High Court's refusal of bail to an accused charged with attempt to murder (Section 307/34 IPC) and offences under the Bombay Police Act and Arms Act. The accused had been in custody since May 2016. The Court noted that a co-accused facing identical charges had already been released on bail. Considering the extended period of custody and the principle of equal treatment of similarly situated accused, the Supreme Court allowed the appeal, set aside the High Court's order, and directed the trial Court to release the appellant on bail with such conditions as it deemed appropriate."
