In Brief
Rampratap was convicted of murder and sentenced to life imprisonment by the trial court. The High Court converted the conviction to culpable homicide not amounting to murder under Section 304 Part-I IPC and sentenced him to 10 years imprisonment, finding he had exceeded his right of self-defence. The Supreme Court upheld the conversion but found the 10-year sentence harsh. Considering that the complainant party had initiated stone-pelting (injuring the accused's mother) and the accused was a young family member responding to that injury, the Court reduced the sentence to the period already undergone (approximately 8 years), thereby allowing the appeal."
