Ramswaroop Soni vs State of Madhya Pradesh & Anr

Bench: 2 — Uday Umesh Lalit

In Brief

A man appealed against a Magistrate's order directing police to file a charge-sheet after police had submitted a final report stating no offence was made out. The Supreme Court held that when a final report is filed under Section 173(2) Cr.P.C., a Magistrate has only three lawful options: accept the report, reject it and take cognizance, or order further investigation. Directing police to file a charge-sheet falls outside these permissible categories. The Court allowed the appeal, set aside the Magistrate's order, and remitted the matter for fresh consideration according to law.
