State of Madhya Pradesh vs Babbu Rathore & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The State of Madhya Pradesh challenged a High Court order quashing criminal proceedings against accused persons. The deceased died by strangulation (unnatural death confirmed by post-mortem). The High Court had improperly quashed proceedings under the Indian Penal Code while the investigation was competently conducted. The Supreme Court partly allowed the appeal, restricting the High Court's quashing order to offences under the SC/ST Atrocities Act only. The trial for murder (Sections 302/34 IPC) must proceed, and the Special Court was directed to continue proceedings expeditiously in accordance with law.
